Ride Ventoux Social Ride Rules
All Ride Ventoux Ride Out Events are social Group rides and training rides - never a race. For this ride, each participant brings their own bike that matches the sport (e.g. road bike), as well as necessary own clothing and equipment (helmets, shoes, rain gear etc.). Eligible to participate are all natural persons who have completed the 18th year of age and are physically able to practice cycling. Ride Ventoux is an event mediator and not an organizer so all the ride events are free of charge.
By participating in one of the events, you agree to the following terms of use. By participating in the Ride Ventoux Strava Events, you also expressly confirm:
- that there are no health restrictions for participation (each participant is responsible for assessing their own health conditions for participation - the organizer assumes no liability for health risks of the participants in connection with the participation in the event);
- that you observe and comply with the road traffic regulations (including locally applicable laws) during the ride;
- that you acknowledge the leadership and authority of a possibly provided Ride Leader and follow his instructions;
- that you use a roadworthy road bike, wear a proper, standard-compliant (CE) helmet, tail and headlight (CE) with full charge that will last all the riding event;
- that you agree to the taking of photos and videos of your person within the scope of the event;
- that you agree to the free publication of the photos and videos of you within the scope of the event (e.g. social media). By participating in the Ride Ventoux Rides, you automatically give your consent to the free publication for the purposes mentioned, without requiring your express consent;
- that you participate voluntarily and at your own responsibility and risk;
- that you cannot appeal or take legal action against an exclusion from the Ride Ventoux, as well as further Ride Ventoux Rides due to unsportsmanlike or dangerous riding;
- that neither the organizer nor the company Energi Bisiklet SARL are liable for damages that arise in connection with the event - except for damages that are based on an intentional or grossly negligent breach of duty. The damages can be caused by - but not exclusively: collisions with pedestrians, vehicles, other riders, movable or immovable objects; hazards arising from the condition of the route, from the failure of equipment items, from the weather, from insufficient safety equipment, from accessories or material, etc.;
- that risks may arise from participating in the Ride Ventoux Social Rides and your own actions as well as from the actions or omissions of other participants of the event, from the condition of the area and the road conditions, in the area where events take place, from the weather and the conditions under which the event takes place as well as from the behavior of the participant himself or other persons not involved in the event.
Liability and insurance
- You as a participant are fully responsible for your actions and are liable on your own responsibility according to the legal regulations. You are obliged to comply with all legally applicable rules, especially to comply with the obligation of consideration in road traffic towards any other road user.
The organizer is not liable for damages caused by participating in the Ride Ventoux Social Rides for the typical dangers of cycling consciously entered into by the participant, especially not for those caused by the participant's own responsible actions. He is also not liable for damages caused by the actions of third parties to the participants. - For property damage, liability is limited to cases of intent or gross negligence. Liability for simple negligence is excluded. This does not apply to damages resulting from injury to life, body or health, which are based on a negligent breach of duty by the organizer or an intentional or negligent breach of duty by a legal representative or vicarious agent of the organizer. For other damages, this does not apply to those that are based on a grossly negligent breach of duty by the organizer or on an intentional or grossly negligent breach of duty by a legal representative or vicarious agent of the organizer.
- You as a participant are responsible for your own insurance coverage during participation in the event. If fees are charged by the organizer for events, these do not include any insurance coverage in case of accident, illness or other insurance cases.
- You as a participant are aware that in the event of an accident for which the organizer is not liable according to these conditions, you yourself are responsible for damages and possibly incurred fees and costs. This includes, but is not limited to, the costs of a police, fire or emergency service, or comparable services such as a mountain or high-altitude rescue. Should a situation arise in which participants are not able to make the decision to alert an emergency service or omit to do so, although this appears advisable from the point of view of an objective third party, they hereby already give their consent that this will be done by a vicarious agent of the organizer or another person commissioned by him for the participant at his expense. The participant cannot claim any compensation from the organizer for any costs incurred in this regard.
- You as a participant are hereby informed that instructions during the ride and route during the event may differ from the originally communicated and advertised instructions and briefings of the respective organizer, because important changes in the traffic routing or other unforeseeable events require this.
